ListContent.Toolbar not working after upgrade

I have upgraded from 6.x to 8.4.2.
Unfortunately the following template code does not work anymore. as no ListControl object iscreatetd:

@if (DotNetNuke.Common.Globals.IsEditMode())
{
<div class="SettingsContainer" >Einstellungen: @ListContent.Toolbar</div>
}

Am I missing something?

It seems that the ListContent object is only available, when there is an existing instance for the module.
The only way to modify a "non existing" ListContent is by assigning a demo instance.

I think that even when no instance is available, the Toolbar should be possible to render, otherwise its not possible to edit the value.
